1. To which services does this Online Privacy Statement apply?

This Online Privacy Statement applies to all websites and portals of SD Worx Staffing Solutions that provide access to our online services and are connected with this Online Privacy Statement.

Additionally, this Online Privacy Statement also applies to the registration and processing of all personal data provided by a user to SD Worx Staffing Solutions for the use of services offered by SD Worx Staffing Solutions, whether as a (candidate) temporary worker, as a (candidate) employee, as a (candidate) participant in training, as a contact person of a client, or for any other activities or services offered by SD Worx Staffing Solutions. SD Worx Staffing Solutions will only use the received personal data for the purposes described in this Online Privacy Statement.

2. What information do we collect from you?

2.1. Information You Provide to Us

When you communicate with us through our website, email, telephone, fax, and social media, you provide us with data. We also collect your personal information when we create a user account for you to access our online services.

The personal information you provide to us may include:

  • Information you provide to us through a web form, such as the application form, newsletter subscription, event registration, or training on the website.

3.1.1. Temporary Workers

When you are looking for a temporary job or working as a temporary worker with us, we process your personal data to:

  • Assist you in finding a suitable job.
  • Communicate with you about open positions and the progress of any applications.
  • Provide notifications about open positions that we believe may interest you.
  • Assist and advise you during your job search and, if desired, place your profile and/or curriculum vitae, whether anonymized or not, on the SD Worx Staffing Solutions website.
  • Assess your suitability for a specific position or assignment, and, if necessary, allow you to participate in (online) tests and generate test results.
  • Offer you work, assignments, training, career and/or career advice, and other work-related services.
  • Connect you with or introduce you to various clients and/or contacts of SD Worx Staffing Solutions, and fulfill our obligations to clients when you are offered a job.
  • Allow you to perform tasks, provide services, and work on projects for these clients and/or contacts.
  • Comply with our obligations as an employer when you are offered a job, including conducting and managing your registration, verifying the completeness and accuracy of data, establishing and managing an employment relationship, or a relationship aimed at acquiring/executing assignments, and maintaining the necessary administration, including personnel and payroll administration.
  • Provide your data to suitable future clients.
  • Provide your data to processors engaged by SD Worx Staffing Solutions to perform certain tasks.
  • Provide you with information about general trends in the job market, labor market, and our own user database, including analyzing all users.
  • Periodically send one or more trade journals and/or magazines relevant to professional knowledge, either digitally or in print (if and to the extent you are eligible), including the SD Worx Staffing Solutions newsletter.
  • Inform you about products and/or services from carefully selected partners of SD Worx Staffing Solutions by posting information on its website or including information in its newsletter.
  • Use your data and disclose it to clients, contacts, subcontractors of SD Worx Staffing Solutions, and government authorities.
  • Provide your data to other companies in the SD Worx Staffing Solutions group, including that your data is (also) included in the database of these affiliated group companies.

3.1.2. Payrolling
When you have been selected by one of our clients and are referred to us to handle payroll administration, we process your personal data to:

  • Enable you to perform tasks, provide services, and work on projects for these clients and/or contacts.
  • Comply with our obligations as an employer when you are offered a job, including conducting and managing your registration, verifying the completeness and accuracy of data, establishing and managing an employment relationship, or a relationship aimed at acquiring/executing assignments, and maintaining the necessary administration, including personnel and payroll administration.
  • Provide your data to processors engaged by SD Worx Staffing Solutions to perform certain tasks.
  • Provide you with information about general trends in the job market, labor market, and our own user database, including analyzing all users.Periodically send one or more trade journals and/or magazines relevant to professional knowledge, either digitally or in print (if and to the extent you are eligible), including the SD Worx Staffing Solutions newsletter.Inform you about products and/or services from carefully selected partners of SD Worx Staffing Solutions by posting information on its website or including information in its newsletter.
  • Use your data and disclose it to clients, contacts, subcontractors of SD Worx Staffing Solutions, and government authorities.
  • Provide your data to other companies in the SD Worx Staffing Solutions group, including that your data is (also) included in the database of these affiliated group companies.
  • If your employment with our original client comes to an end, you will automatically become a temporary worker. From that point on, the other section of this privacy statement applies.

3.1.3. Employees of SD Worx Staffing Solutions

When you are looking for a job as an employee with us or are employed by us, we process your personal data to:

  • Communicate with you about open positions and the progress of any applications.
  • Provide notifications about open positions that we believe may interest you. Assess your suitability for a specific position or assignment, and, if necessary, allow you to participate in (online) tests and generate test results.
  • Offer you work, assignments, training, career and/or career advice, and other work-related services.

If you, as a client, request us to work with you, we process your personal data to:

  • to provide you with information about general trends in the job market, the labor market and to analyze our own database of all users;
  • periodically sending you one or more professional knowledge relevant magazines and/or journals, digital or otherwise (if and insofar as you are eligible) including the SD Worx Staffing Solutions newsletter;
  • to supply your details to other companies in the SD Worx Staffing Solutions group, whereby your details will (also) be included in the database of these associated group companies;
  • to send you information about other interesting related solutions, invitations to events or surveys to improve our services.

3.1.5. To personalize and improve your experience on our websites, portals and applications

We use your personal information to personalize our website, portals and applications based on your usage and preferences so that you have a good experience.

We collect aggregate analytics data from our websites, portals and applications to continuously optimize our digital platforms. We ensure that all data we collect for this purpose is anonymized

SD Worx Staffing Solutions does not disclose users' personal data to third parties, except as indicated in this Online Privacy Statement, for the purpose of verifying the completeness and accuracy of this data, in compliance with applicable privacy laws and regulations, when requested or required by an official authority, to protect SD Worx Staffing Solutions' rights, prevent a crime, and/or safeguard the safety of its users and/or third parties.

Your personal data is only disclosed to a processor to the extent necessary to perform the tasks assigned by SD Worx Staffing Solutions. SD Worx Staffing Solutions has taken the necessary measures to ensure the safe disclosure of this data. In a processor agreement entered into for this purpose, the processor is obligated not to disclose or use the personal data for purposes other than those for which it was obtained.

If your data is provided to the affiliated group companies of SD Worx Staffing Solutions, and the data is (also) included in the database of these group companies, this Online Privacy Statement applies to the processing of your data by these group companies. It should be noted that where 'SD Worx Staffing Solutions' is mentioned, the name of the respective group company should be read.

We also process personal data to respond to reasonable requests from competent law enforcement agencies or representatives, the judiciary, and government authorities or organizations, including competent data protection authorities.

Your personal data may be transferred to the police or the judiciary as evidence, either at our initiative or in the event of reasonable suspicion of an unlawful act or crime committed by you.

5. How do you access, control, and delete your personal data?

You have the right to request all your personal data processed by us.

You have the right to ask us to correct any incorrect personal data about you free of charge. If such a request is submitted, it must be accompanied by proof that the data to be corrected is indeed incorrect.

You have the right at any time to withdraw your previously given consent to process your personal data or to adjust your communication preferences.

You have the right to request the deletion of your personal data if they are no longer necessary for the purposes described in this Online Privacy Statement. However, please note that such a deletion request by us will be evaluated taking into account:

higher interests of SD Worx Staffing Solutions or any third party; and legal or regulatory obligations, or legal or administrative orders contradicting such deletion. Instead of requesting us to delete your personal data, you can also ask us to limit its processing when (a) you dispute the accuracy of the data, (b) its processing is unlawful, or (c) the data are no longer necessary for the purposes described in this Online Privacy Statement.

An email containing a request to exercise a particular right cannot be interpreted as consent to process your personal data, except to the extent necessary to process your request. SD Worx Staffing Solutions shall not be liable for any damages resulting from the use of personal data by third parties to whom this data was provided in accordance with this Online Privacy Statement or with your consent. Nor can SD Worx Staffing Solutions be held liable for any non-compliance with laws and/or regulations by third parties.

8. How do we protect your information?

SD Worx Staffing Solutions makes every effort to implement appropriate organizational and technical measures to secure your personal data against unauthorized processing and/or loss. Employees of SD Worx Staffing Solutions who have access to your personal data are bound by a confidentiality agreement.

We are committed to keeping your data secure and rely on security experts who oversee the security measures we take. We have an information security program with administrative, technical, and physical security measures that we implement and continuously update. This includes safeguards such as firewalls and data encryption, physical security, and access control.

Take steps to protect your personal information online as well. Choose a strong password and do not use the same password you use for other sites. Do not share your password with anyone. SD Worx Staffing Solutions will never ask for your password in an unsolicited phone call or email. Also, remember to log out of the website and close your browser window when you have finished your work.

SD Worx Staffing Solutions accepts no liability for unlawful actions by third parties who, despite the measures taken, manage to circumvent them or use personal data for unauthorized purposes.

SD Worx Staffing Solutions reserves the right to amend this Online Privacy Statement from time to time to reflect changes in privacy practices or new privacy practices in accordance with this provision.
